How to notify us of and remove content that infringes copyright

Our commitment

DEVIL CLUB LLC respects the intellectual property rights of others and expects its users to do the same. This policy describes the procedure we follow for claims of copyright infringement under the United States Digital Millennium Copyright Act (DMCA, 17 U.S.C. § 512).

If you believe that content hosted on or accessible through our website infringes your copyright, you may send us a takedown notice as described below. We will remove or disable access to material that is the subject of a valid and complete notice.

How to submit a takedown notice

So that we can act on your claim, the notice must be sent in writing to our designated agent (see section III) and must include all of the elements required by 17 U.S.C. § 512(c)(3):

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work you claim has been infringed (or, if multiple works, a representative list).
  3. Identification of the allegedly infringing material, with enough information for us to locate it: the exact URL or another precise reference.
  4. Your contact details: full name, mailing address, telephone number and email address.
  5. A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent or the law.
  6. A statement that the information in the notice is accurate and that, under penalty of perjury, you are authorized to act on behalf of the copyright owner.
Important

An incomplete notice may have no legal effect and could delay or prevent processing. If you are unsure about your rights, we recommend consulting a legal advisor before sending it.

Takedown notices and counter-notifications must be directed to DEVIL CLUB LLC's designated agent for copyright matters:

We recommend writing "DMCA Notice" in the subject line of your email to speed up processing.

Counter-notification

If your content was removed or disabled and you believe this was a mistake or a misidentification, you may file a counter-notification under 17 U.S.C. § 512(g). The counter-notification must include:

  1. Your physical or electronic signature.
  2. Identification of the removed material and the location at which it appeared before removal.
  3. A statement, under penalty of perjury, that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  4. Your name, mailing address and telephone number, together with a statement that you consent to the jurisdiction of the federal court for your district (or, if you reside outside the United States, any district in which we may be found) and that you will accept service of process from the person who filed the original claim.

After we receive a valid counter-notification we may restore the material within 10 to 14 business days, unless the original complainant notifies us that they have filed a court action to prevent it.

Repeat infringer policy

In accordance with 17 U.S.C. § 512(i), DEVIL CLUB LLC may, in appropriate circumstances, suspend or terminate the accounts of users who repeatedly infringe the copyrights of others.

False or bad-faith notices

Under 17 U.S.C. § 512(f), any person who knowingly misrepresents that material is infringing, or that it was removed by mistake, may be liable for the resulting damages and costs. Send notices only when you are convinced in good faith that your claim is legitimate.
