Is the Registered Agent's address my office in the United States?
No. The Registered Agent's address exists to receive legal notices and keep the LLC registered, but it does not turn that address into your actual office. For banks and verifications, treat it as what it is: a legal service address, not a place of business.
Do I need an SSN, an ITIN, or to travel to the United States to open the LLC?
You do not need to travel or hold an SSN to form an LLC. The EIN is requested from the IRS after formation. The ITIN only comes into play in specific cases — for example if your tax situation requires filing a personal return in the US. Formation itself does not require you to set foot in the country.

How do I close my LLC if I no longer use it?
Closing an LLC has two fronts: the state dissolution (Articles of Dissolution with the Secretary of State) and, if your LLC had reportable transactions, the Final Tax Filing (final 5472 + 1120). Doing only the first leaves the federal side open; doing only the second leaves the entity alive before the state.
How much does it cost to dissolve an LLC?
The state closing is a one-off payment: $300 if you are a Devil Club client (your Final Tax Filing for the year is already included in your maintenance) and $450 for an external LLC or non-client (with the Final Tax Filing included). There is no recurring fee: once closed, it is closed.

⚠️ Is Wise asking you to verify your business address?
It's normal. Wise distinguishes between the LLC's registered address and the physical address you operate from. If your business is digital and you have no office, your real operating address is usually your home. The key is not to invent an office or present the Registered Agent's address as if it were your physical premises.
What to attach: a utility bill, bank statement or equivalent document in your name showing your residential address. It doesn't have to be in the LLC's name if you explain that you're a single-member digital LLC operating from home.
“Hello Wise team: I'm writing in response to your request regarding business address verification. My company is a single-member digital business; it requires no physical office, warehouse or in-person service. The address from which I run the activity is my residential home, which is why the attached proof of address is in my personal name. The LLC's registered address belongs to the Registered Agent, but day-to-day operations are handled from my home. I'm attaching the requested document to complete the verification. Thank you.”
If Wise asks for a second proof, also upload your Articles of Organization, EIN Letter or Operating Agreement. If they keep insisting, message us before replying so we can review the case.

Do I need to do something every day?
No. You only need to check the dashboard once a month and act if there are alerts. The main obligations are annual (Tax Filing, renewal).

What's the difference between Basic and Manager?

Do referral credits expire?
No. Referral credits don't expire and accumulate in your account as long as you keep using Devil Club. They apply automatically to future orders: annual renewal, Tax Filing, forming another LLC, upgrading to Manager or additional services. If your available credit exceeds an order's amount, the remainder is kept for your next purchase. It's internal Devil Club credit, not a cash withdrawal.

Can I have employees or freelancers working for my LLC in Spain?
You can't have salaried employees in Spain hired directly by your LLC, as this would create a «Permanent Establishment» and require taxation as a Spanish company.
However, you can hire freelancers, as long as they don't work exclusively for you or use permanent physical facilities on your behalf.

Can I start a U.S. company from my country without being a resident or citizen?
Absolutely! You can even register your company without traveling, obtaining a visa, social security number (SSN), or individual taxpayer identification number (ITIN). U.S. regulations don't impose restrictions on company formation for citizens worldwide, except for some countries subject to trade sanctions.

What taxes does a Foreign-Owned LLC pay in the U.S.?
If your LLC operates online without a physical presence in the U.S., has no employees or dependent agents, and none of its members reside or are U.S. citizens, it will be classified as Foreign Owned and not considered Engaged in Trade or Business in the US. Without ETBUS designation, it benefits from a territorial tax exemption. In short, if the LLC meets these requirements, it will be exempt from U.S. taxes. Otherwise, it won't qualify for an exemption and must obtain an ITIN and be taxed in both the U.S. and its country of tax residence.

When is an LLC not the best option?
If your business has a physical presence or a Permanent Establishment in Spain (e.g., restaurant, physical location, salaried employees), an LLC alone is not sufficient. In these cases, the LLC can complement a local entity (like a Spanish SL) for the international or digital activity, ensuring compliance with tax regulations in both countries.

What are my responsibilities to the Spanish tax authority?
- During each tax filing in Spain, you'll need to report your LLC's information and its profits for that tax year in the «Attribution of income regime» section of your IRPF tax return.
Modelo 720 (Informative): The LLC must inform the Spanish tax authority about foreign assets and rights that belong to it, if their total value exceeds €50,000. This annual filing includes detailed information on bank accounts, securities, insurance, properties, and other relevant assets.
Related-party transaction information: If the LLC conducts transactions with related parties, it's necessary to maintain documentation supporting these operations and establishing their market value. In case of an inspection, you'll need to provide this information to the tax authority.

What are my responsibilities to the IRS (Internal Revenue Service)?
We'll handle the following IRS forms on your behalf annually:
Form 1120: This document reports your LLC's income and expenses to the IRS for the fiscal year.
Form 5472: This form provides the IRS with information about your business type and details to be reported on Form 1120.
Starting from the year you form your company, you'll need to file the BE-13 with the BEA at formation:
- BE-13: This form helps the Bureau of Economic Analysis track foreign investment by reporting money flowing in and out of the country through businesses.
Additionally, if you operate or plan to operate in the U.S., you may need other forms. Initially, if your activity is based in Europe, you might not need to worry about these:
Form W-7: Used to apply for an ITIN from the IRS, similar to an EIN, allowing you to fulfill your tax obligations in the country.
Form 1040NR: This form is essential at the end of the fiscal year to demonstrate to your country of tax residence that you've paid taxes in the U.S., which may allow you to deduct them in your country of taxation.
Form W-8BEN-E: Required by companies that pay U.S.-source income to your LLC. Your LLC’s EIN is usually enough to fill it in.
- FIRPTA 8288-B: If you're a foreign or international investor, be aware of FIRPTA tax withholding on property sales.
- FBAR 114: If you've had over $10,000 in a non-US bank account at any point during the year.

How do I manage VAT on international operations?
Managing VAT for an LLC operating internationally depends on the nature of services/products and client location. For B2B services, you may apply the reverse charge mechanism. For B2C services in the EU, there are regimes like OSS. It's crucial to ensure compliance with applicable tax regulations in each jurisdiction. Consult an expert for your specific case.

What expenses can I deduct and how?
Before making any expenses, it's crucial to keep a detailed record of them. You can use a spreadsheet like Excel to efficiently track expenses, and to facilitate this task, we provide a template for your use.
That being said, certain expenses your LLC can deduct, and you should keep corresponding invoices, transfer records, and ensure they're registered in your LLC's name:
Common Deductible Expenses:
- Office Expenses: Rent, office supplies, utilities.
- Staff Expenses: Salaries, benefits, training.
- Equipment and Supplies: Purchase and maintenance of equipment, business supplies.
- Business Travel: Transportation, lodging, business-related meals.
- Marketing and Advertising: Costs associated with promoting your business.
- Interest and Fees: Interest on commercial loans and credit cards.
Vehicle Expenses: If the LLC uses vehicles for business purposes, you can deduct related expenses such as gas, maintenance, and depreciation.
Business Education Costs: Costs associated with continuing education or specific business training may be deductible.
Business Insurance: Insurance premiums for commercial coverage, such as liability insurance, may be deductible.
Charitable Contributions: Donations to charitable organizations may be deductible if they meet certain requirements.
Business Taxes and Licenses: Fees and licenses required to operate the business are deductible expenses.
Note that you won't be able to deduct expenses directly related to your home country, such as offices or properties, as this could create tax complications for your LLC operating exclusively from your country of residence.

Are my personal assets protected with an LLC?
If your LLC maintains a clear separation between business and personal accounts, keeps accurate records in Excel, meticulously saves all invoices, and has an Operating Agreement, you have no reason to worry. However, if not, there is a possibility that a U.S. judge will 'pierce the corporate veil,' putting the LLC's legal protection at risk. Therefore, it's essential to rigorously comply with all the above-mentioned aspects.

What documents do I need to apply for a bank account at a U.S. Neobank?
Your company just needs to be duly incorporated and in good standing with all documents, including its EIN (company tax ID), and the manager's up-to-date passport. No Social Security number or ITIN is required. We can't guarantee account opening, as banks must conduct KYC (Know Your Customer) verification, mandatory under federal regulations set by the Patriot Act, before approving a client.

What if I receive a tax authority audit notice about my LLC?
If you receive a notification from the tax authority, stay calm and prepare documentation showing your LLC's compliance with applicable regulations. This includes the Operating Agreement, management contracts, bank statements and accounting records, and U.S. tax forms. It's crucial to justify the LLC's effective management outside of Spain and that no Permanent Establishment is created in your country of residence. Always seek support from a specialized tax advisor.

Can I use my LLC to operate with cryptocurrencies or NFTs?
Yes, you can, but note that any benefits from crypto or NFT operations must be declared in your Spanish IRPF under the income attribution regime. The tax authority closely monitors these activities, so keep precise documentation of all transactions.

How do I get paid in euros if my clients are European?
The easiest way is to use platforms like Wise, Payoneer or Stripe, which allow you to receive payments in euros, easily convert currencies, and transfer funds to your European bank account from the LLC.

What if I have no profits in the LLC one year? Do I still need to file anything?
Yes, even if you don't have profits, you'll need to file Form 5472 and Form 1120 in the U.S. each year to keep your LLC active.
In Spain, if there are no actual profits, you won't have to pay IRPF, but it's recommended to keep records that prove the absence of income.

Is an Operating Agreement required for my LLC?
Legally, it's not required in all states, but it's highly recommended. An Operating Agreement protects your limited liability, strengthens your position during tax inspections, and documents the company's actual corporate governance.

Why do I pay the same in the second year if you're no longer forming my LLC?
Because you're not paying for formation — you're paying for a protection ecosystem that works 365 days a year. LLC formation is a 24-hour process; what's really valuable is ongoing maintenance: compliance, Registered Agent, Tax Filing, 1:1 support, alerts, and the Club. And if you have Manager, the value increases over time: more entries in the Governance Ledger, more accounting history, and more accumulated substance proof. A 2-year ecosystem is much more solid during an inspection than a 3-month one. Plus, your founder price is locked in — while new fees increase.

Do I have to file BOI or BOIR for my LLC?
Under the rule published by FinCEN in March 2025, entities created in the United States — including domestic LLCs — and their beneficial owners are exempt from filing the BOI/BOIR report. The rule is different for certain entities formed outside the US that register to do business there. Because this obligation can change, always check FinCEN's current notice before filing or paying for that process.
What is FATCA and how does it relate to the W-8 forms?
FATCA is a US information and withholding regime that mainly affects foreign financial institutions, certain foreign entities and some US taxpayers with assets abroad. The W-8 family of forms can document foreign status and, where applicable, FATCA classification to the payer. FATCA is not the same as FBAR, and it does not mean that every foreign owner of an LLC has an annual FATCA filing of their own.
Does having an LLC mean paying 0% always?
No. An LLC can be very efficient, but the outcome depends on your tax residency, on where the income is generated, on whether there is physical presence or dependent agents in the US, and on how you take the money out. Anyone promising a flat 0% without looking at your case is selling you a headline, not an answer.
Can I use my LLC if I live in Spain or another high-tax country?
Yes, but it does not erase your personal obligations. The LLC organises the activity and can improve collections, banking, protection and international structure; your tax residency still matters. If you live in a high-tax country, the LLC is a tool, not a way to stop declaring where you live.
What if my LLC had no revenue this year?
Having no income does not remove the annual filing. A foreign-owned SMLLC files the Form 1120 pro-forma + Form 5472 package every year, even with no invoicing and no federal tax due. Skipping it because “there was nothing” is one of the most common — and most expensive — mistakes.
What is the difference between Tax Filing, FBAR and BEA?
Tax Filing is the tax/information filing with the IRS for your LLC. FBAR is a FinCEN report on financial accounts outside the United States once certain balances are exceeded. BEA is a survey by the Bureau of Economic Analysis about foreign investment. They are three different obligations with different triggers: meeting one says nothing about the other two.
Do I have to file a final return when dissolving the LLC?
Almost certainly yes. The final 5472 + 1120 are triggered by reportable transactions, and Part V of the 5472 itself covers the formation and the dissolution of the entity, as well as contributions and distributions. Dissolving without filing does not close the federal obligation: it leaves it pending.

What does "territorial" mean?
A territorial tax system only taxes income generated within its borders. If your money comes from abroad (for example, from a US LLC), the territorial country doesn't tax you on it. It's the foundation of most international tax optimization strategies.

Do all LLCs with a foreign owner need to file BE-13?
Yes. Any U.S. company created or acquired by a foreign investor (individual or entity) with a 10%+ stake must file some variant of BE-13.
What if more than 45 days have passed?
You still can — and should — file. Better late than not at all. Historically, the BEA has been more flexible with late filings than with total omissions.
Is BE-13 filed every year?
No. BE-13 is filed only once, within 45 days of forming or acquiring the company. It's not a recurring obligation (unlike Tax Filing or FBAR).
What's the difference between BE-13 and FBAR?
They're different forms with different agencies. FBAR (FinCEN Form 114) is filed with FinCEN when you accumulate more than $10,000 in financial accounts outside the U.S. BE-13 is filed with the BEA after forming the LLC. Different purposes: FBAR tracks foreign accounts, BE-13 records inbound foreign investment.

What if my LLC never reached $10,000?
If the aggregate balance across all accounts never exceeded $10,000 at any point in the year, you're not required to file the FBAR. When in doubt, verify — don't assume.
Is the FBAR the same as FATCA?
No. The FBAR is filed with FinCEN. FATCA (Form 8938) is filed with the IRS. These are two separate obligations with different thresholds and forms. For disregarded LLCs, FBAR usually applies.
Can I file the FBAR myself?
Technically yes, through the BSA E-Filing portal. But the process requires knowing exactly which accounts to file, how to calculate the maximum balance and in what format. An error can trigger penalties.
What if I didn't file in prior years?
There are procedures to regularize prior years. Contact us to assess your specific situation. Voluntary regularization is better than waiting for FinCEN to detect it.

Can I just leave without notifying anything and disappear?
Fatal mistake. Hacienda doesn't measure suitcases, it measures chains. If you leave physically but don't cut the legal cables (030, accounts, padrón), to them you're still having dinner at home every night.

If I spend fewer than 183 days in Spain, am I free?
False. That's only one of the three locks. You can spend 0 days in Spain and still be a resident if your spouse, your children or your main company are still there (Centre of Interests).

Is living in Airbnbs (Perpetual Tourist) enough?
Danger. Hacienda doesn't look for fixed addresses, it looks for patterns. If you don't have a provable tax residency in another country (with a certificate), your residency automatically bounces back to Spain.

It's a shield, not a force field. It helps enormously, but if the rest of your life screams “Spain”, a judge can knock the paper down. Reality must match the document.

What gives people away the most?
Inconsistency. Claiming you live in Dubai but paying for electricity, the kids' school and the Madrid supermarket with your personal card. The digital “breadcrumb trail” doesn't forgive.

What if I have no income in Spain, but I do abroad?
Irrelevant. Spanish tax residency is “worldwide”. If you're a resident, Spain wants its share of what you earn in Germany, in the USA or in Crypto. It doesn't depend on where the money is generated, but on where you reside while you generate it.

Can I live abroad and invoice through my Spanish S.L.?
Dangerous. If you live abroad, your Spanish S.L. can become a problem. Keeping active structures in Spain reinforces your economic tie to the country you want to leave.

My company is abroad but I live in Spain?
Audit bait. It's called “Place of Effective Management”. If the brain making the decisions (you) is in Albacete, then to Hacienda that company is from Albacete, even if the paperwork says New Mexico.

If I don't own a home in Spain, am I safe?
No. The concept is “available home”. An annual rental, your parents' house where your room is kept intact, or a summer house can be used to show you have a “permanent base” in Spain.

Can I leave my family in Spain and move to Andorra on my own?
Almost impossible. The IRPF Law presumes you're a resident if your spouse and minor children live in Spain. Unless you legally divorce or prove a radical separation of assets and lives, they'll drag you along with them.

What if I don't register anywhere so I'm “stateless”?
Bad idea. The absence of paperwork hurts you more than it helps. Without a tax certificate from another country, you have no shield to defend yourself when Spain comes calling. You're an easy target.

Can I get paid by a foreign company while living in Spain as a tourist?
The classic mistake. Immigration status (a visa) is not the same as tax status. You can be in the country illegally as a tourist and still be perfectly well a tax resident if you spend 183 days. Hacienda will charge you all the same.

What if I put everything in the name of a Foundation or nominee?
Fiscal Transparency. Today, “Beneficial Ownership” (UBO) registers exist. Hacienda can look through shell companies to see who the ultimate beneficiary is. Hiding ownership today is a crime, not avoidance.

Can I leave one year, come back another, and avoid problems that way?
Red flag. Intermittent schemes raise suspicion. Temporal inconsistency is usually interpreted as “sporadic absences” (long holidays), not as real changes of residency. Hacienda looks for stability.

Is there any country where “they don't check anything”?
That era is over. With CRS and DAC7, exchange is the standard. There are territorial countries (Panama, Costa Rica) or low-tax ones (Andorra), but “black hole” countries are traps for your money.

What if I have no income for a while as I leave?
It helps, but it's not enough. If you hold assets, they can apply the Wealth Tax or the Large Fortunes Tax under “personal liability”, even if you have no income that year. Residency goes beyond the payslip.

If all my money is in Crypto outside Exchanges, Hacienda knows nothing?
For now. But the MiCA regulation and the new reporting forms are coming for it. On top of that, if you spend that money in the real world (buying a house, a car, using a card), the alarm will trip for an “unjustified increase in wealth”.

Can I live in one country and have my company taxed in another?
Yes, it's the Holy Grail. (E.g.: Living in Portugal with a company in Estonia or the USA). But it requires surgical execution to avoid falling under international tax transparency rules (CFC Rules). It can be done, but with a scalpel.

Which is the easiest country to stop being a Spanish resident?
If you're looking for “easy”, you're on the wrong track. Look for safe. Portugal or Andorra are easy because they're close, but dangerous because of the surveillance. The answer depends on your profile, not on the country.

We file with the IRS through whatever official channel each form admits — e-file when allowed, and fax or certified mail in the case of the 1120 pro-forma + 5472 for a foreign-owned SMLLC.
Can I file Form 5472 myself or with a cheap preparer?
Legally you can self-file if you're the owner. But you need to master: Form 1120 pro-forma (not the regular 1120), Form 5472 with the correct Reportable Transaction Codes, full Related Parties disclosure, and physical mail or fax submission. Per IRS instructions for Form 5472, this filing cannot be submitted electronically for a foreign-owned U.S. disregarded entity; it must be sent by fax or mail.
If you pay someone, that person must have a PTIN (Preparer Tax Identification Number) from the IRS. Fiverr-style services, accountant brothers-in-law, and non-US bookkeepers without IRS credentials cannot legally sign as paid preparers. If they sign without a PTIN, that's fraud; if they don't sign, the entire liability before the IRS falls on you.
The penalty for error or omission is $25,000 base + $25,000 every 30 days after notice. The expected cost of DIY far exceeds the price of any serious professional service.

Annual Filing covers a Disregarded LLC with a single individual owner: 1120 pro-forma + 5472 + Related Party schedules. Complex Structures is for cases where the LLC is owned by a Panamanian FIP, a holding company, or has transactions with multiple related entities that require multiple 5472s with their own attachments.
What is a Related Party?
In short, any entity or individual with direct or indirect control over your LLC. That includes: you as the owner, immediate family, other holdings you own, or even foundations (FIP) that hold the equity.
What is the NAICS code?
An industry classification system (North American Industry Classification System). The IRS uses it to identify which sector your business operates in. You don't have to look it up — we assign it from your activity description.
What does "Disregarded Entity" mean?
It means that for IRS purposes, your LLC and you (or your holding) are treated as the same entity for income tax. The LLC "disappears" and profits flow directly to the owner. That's why it doesn't pay corporate tax — but it does have informational reporting obligations.
Is filing mandatory even if my LLC had zero revenue?
Yes. If your LLC has an EIN, you must file Form 5472 + Pro Forma 1120 with the IRS, regardless of whether the LLC had any activity, income or expenses. Failure to file triggers a $25,000 penalty per LLC per tax year.
What happens if I don't file on time?
The IRS may assess a $25,000 penalty per form when a required Form 5472 is late, substantially incomplete, or required records are not maintained. Additional continuation penalties may apply after an IRS notice. The general deadline for calendar-year entities is April 15 (or the next business day), unless a valid extension applies.
Which forms exactly get filed?
For a foreign-owned Single-Member LLC we file: Form 5472 (transactions with foreign related parties) + Pro Forma 1120 (LLC informational return). If applicable, also FBAR (FinCEN 114) for foreign accounts with a combined balance over $10,000 at any point during the year.
Do I need an ITIN to file?
Not required. For Form 5472 you can use your foreign tax ID (DNI, NIF, NIE, passport, etc.). An ITIN is useful if you later want to open US credit or file personal income returns, but it's not a requirement for this informational filing.
What is FBAR and when does it apply?
FBAR (FinCEN 114) is a foreign financial account report. It applies to you if at any point during the year the combined balance of all your non-US accounts exceeded $10,000. That includes Wise (EUR accounts), Payoneer, Revolut and similar if they sit outside the US. It's not a tax - just an informational filing.
Which LLC accounts do I need to report? (Mercury, Wise, Payoneer...)
It depends on where the account is located, not on the bank or the app:
- US accounts (Mercury, Relay, Wise USD balance held in its US entity, Brex, etc.) - NOT reported on FBAR. They do appear as related-party transactions on Form 5472 if there are flows between you or your other entity.
- Non-US accounts (Wise EUR/GBP in Belgium, Revolut EU, Payoneer outside the US, Airwallex, local banks) - DO count for FBAR if the combined balance exceeded $10,000 at any point during the year.
Practical rule: if the account belongs to the LLC (even if you opened it), the FBAR holder is the LLC - not you personally. All LLC accounts, wherever they sit, are listed in the annual dossier for traceability.
Can I file late?

What should I have ready to open a bank or fintech account?

Accounts are not rejected for lack of luck: they are rejected for an activity that cannot be explained.
Can I open a US bank account without traveling to the United States?
Yes. Mercury, Relay, Wise and Meru let you open an account 100% online with a foreign passport + EIN. You don't need to set foot in the USA or have a personal address there. The process takes between 10 minutes (Meru) and a few days (Mercury, depending on the review).

Do I need the EIN before opening the account?
Yes, mandatory. All US banks and fintechs require the EIN (Employer Identification Number) from the IRS to open a business account. It's the equivalent of the company's tax ID. Without an EIN, you can't open any account in your LLC's name.

It's more common than it seems. Next step: try Relay (same profile, similar process) or Meru (built for non-residents). Is it legal to have an account not reported under CRS?
Yes. The United States doesn't participate in CRS as a reporting jurisdiction under that standard and uses FATCA instead. Opening an account at Mercury, Relay or Brex is as legal as opening one at any other bank in the world. Your obligation is to declare the account in your country of tax residence when applicable (e.g. Modelo 720 in Spain). Not declaring it could be illegal; having the account is not.

Can I use Revolut personal instead of business for my LLC?
No. Using a personal account for your LLC's income violates Revolut's terms of service (and any bank's) and breaks the LLC's legal separation. Also, Revolut personal EU can report under CRS. Note that Revolut Business requires a physical office in the USA to open an account: that's why it's not an option for the typical non-resident owner, who runs their LLC remotely and with no physical presence in the country. Only if your US entity proves that physical presence (a real office in the USA) could it qualify. For the usual non-resident LLC, use Mercury, Relay, Wise or Meru.

Does Payoneer report to CRS? Wasn't it an American company?
Yes, Payoneer can report under CRS. Although Payoneer Inc. is American (listed on Nasdaq), the entity that manages many accounts in Europe is Payoneer Europe Limited, classified as a financial institution under CRS. That can mean automatic reporting to your country's tax authority. Don't confuse headquarters with the regulatory entity.

⚠️ Does Wise ask you to verify your business address?
That's normal. Wise distinguishes between the LLC's registered address and the physical address you operate from. If your business is digital and you don't have an office, your actual operating address is usually your home. The key is not to invent an office or present the Registered Agent's address as if it were your physical location.
What to attach: a utility bill, bank statement, or equivalent document in your name with your residential address visible. It doesn't need to be in the LLC's name if you explain that you're a single-member digital LLC operating from your home.

Which W-8 does my LLC need: W-8BEN or W-8BEN-E?
In the usual case of a single-member LLC owned by a non-resident individual, the form is normally the W-8BEN: it documents to whoever pays you that you are a foreign person. The W-8BEN-E is for foreign entities — for example when the LLC's owner is another company. It is not filed with the IRS; you hand it to the payer or platform that asks for it. Review the full picture before signing if the LLC has several members, a corporate owner or a different tax election.
When is a W-9 used and when a W-8BEN?
The W-9 is used to request the taxpayer number and certain certifications from a US person, including a US tax resident. The W-8BEN documents the foreign status of an individual to whoever pays them. In a disregarded LLC, the form and the details depend on the tax classification and on the owner; don't pick one just because the invoice carries the LLC's name.
Can I mix personal expenses and LLC expenses?
It is not advisable. One of the foundations of a healthy LLC is keeping personal and corporate apart: accounts, invoices, contracts and payments. If you pay something personal from the company or something of the company from your own pocket, document it and settle it properly — an undocumented mix weakens exactly the separation the LLC exists to provide.
