The 3 misses — with the real penalty
Up to $25,000

Not filing 5472 + 1120

The annual IRS filing for your LLC's transactions with the owner. Missing it when it applies = a $25,000 penalty.

From $16,536

Not reporting the FBAR

If your accounts outside the US top $10,000 at any point in the year. Willful: up to $165,353 or 50% of the balance.

Up to $59,114

Not filing the BE-13 Claim for Exemption

The BEA foreign-investment census, once only at formation (45 days). It arrives by mail and nobody opens it.

🛡️ And what you must NOT file: the BOIR. Since March 2025, FinCEN exempted every company created in the US from reporting it. Your LLC is created in the US → exempt. (Source: fincen.gov/boi.)

The good news: whether you're a Basic or Manager client, we file this for you. You review and approve — you don't fill IRS forms against the clock.
